How does the arbitration process work?
Securities arbitration is held usually before the National Association of Securities Dealers, Inc. (NASD). A case is started when an attorney files a claim on behalf of a stock fraud victim with the NASD in New York City. The claim is administered by the Chicago office, who assigns each claim to be heard in 1 of the 8 regional offices throughout the United States.

How long does it take?
Approximately 1 year from the initial filing to the arbitration hearing.

Can’t I just write a letter to the NASD?
The NASD might look into things and might investigate your complaint, but at the end of the day, it will not take action to get your money back for you. That is not their function. The NASD is a self-regulated organization made up of the same broker-dealers that it investigates. It will only address disputes in arbitration.

When is it too late to file a claim?
Generally, statutes of limitations do apply. But in matters involving a cover-up on the part of the broker or investment firm the filing deadlines may not apply. Whatever your situation is, it is important to call a securities attorney as soon as possible.
